1. Agreement to Terms

BY DOWNLOADING, INSTALLING, OR USING THE BURBANK SPORTSCARDS APPLICATION ("APP"), YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE ("TERMS"). IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Burbank Sportscards ("Company," "we," "us," or "our"). We reserve the right to update these Terms at any time without prior notice. Your continued use of the App following any changes constitutes acceptance of those changes.

2. Eligibility

To use the App, you must:

• Be at least 18 years of age, or at least 13 years of age with verifiable parental consent

• Have the legal capacity to enter into a binding contract

• Not be barred from using the App under applicable law

• Provide accurate, complete, and current registration information

By using the App, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate your account at any time if we determine, in our sole discretion, that you do not meet these requirements.

3. Account Registration and Security

3.1 Account Creation

You must create an account to access the App. Account login is required because core features — including loyalty rewards, VIP tier benefits, order tracking, personalized notifications, and the Collector's Club program — are tied to your customer account. You agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy.

3.2 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your login credentials

• All activity that occurs under your account

• Immediately notifying us of any unauthorized access to your account

• Ensuring that you log out of your account at the end of each session

We shall not be liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to disable any account at any time at our sole discretion.

3.3 Account Deletion

You may delete your account at any time through the App by navigating to Profile > Settings > Delete Account. Upon deletion, your account data — including notification preferences and activity history — will be permanently removed. Certain information may be retained as required by law or for legitimate business purposes such as fraud prevention.

4. Permitted Use and Restrictions

4.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal, non-commercial purposes.

4.2 Prohibited Activities

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of the App or its content

• Reverse engineer, decompile, or attempt to extract the source code of the App

• Use the App for any illegal, fraudulent, or unauthorized purpose

• Circumvent or attempt to circumvent any security or authentication measures

• Use automated means (bots, scrapers, crawlers) to access the App

• Upload or transmit viruses, malware, or other malicious code

• Impersonate any person or entity or misrepresent your affiliation

• Harass, threaten, or intimidate other users or staff

• Use the App in any way that could overburden or impair our infrastructure

• Violate any applicable local, state, national, or international law or regulation

5. Purchases and Payments

5.1 Physical Goods

All products available through the App are physical goods — including sports cards, memorabilia, and related collectibles — sold directly by Burbank Sportscards. Products are shipped to customers or available for in-store pickup.

5.2 Checkout and Payment Processing

All purchases are processed through Shopify's checkout system. Burbank Sportscards does not directly collect, store, or process your full payment card information. Payment processing is handled entirely by Shopify and its payment partners in accordance with their terms and privacy policies.

5.3 Pricing and Availability

All prices are listed in U.S. dollars. We reserve the right to change prices, modify product availability, and correct pricing errors at any time without prior notice. Product availability is subject to change and is not guaranteed until checkout is completed.

5.4 Refunds and Returns

Refund and return policies for purchases are available at burbankcards.com/pages/returns-exchanges. All refund requests are handled in accordance with that policy.

5.5 Discount Codes and Promotions

Discount codes — including those earned through our loyalty rewards program — are subject to terms and conditions specified at the time of issuance. We reserve the right to modify or discontinue promotional offers at any time.

6. Loyalty and Rewards Program

The Collector's Club is a free loyalty program powered by Smile.io. Participation is voluntary and does not require any payment or subscription. Members earn points through qualifying purchases and may redeem points for discount codes.

VIP tier status is based on cumulative points earned. Tier benefits, including percentage-based discounts, may change at our discretion. Loyalty points have no cash value and are non-transferable. We reserve the right to modify, suspend, or discontinue the rewards program at any time with notice to participants.

By participating in the Collector's Club, you agree to Smile.io's terms of service and privacy policy, available at smile.io/privacy-policy.

7. User-Generated Content

By submitting content through the App or in connection with our physical storefront or social media presence (including photos, reviews, comments, or other materials), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, distribute, and display such content in any media or distribution method.

You represent and warrant that you own or have all necessary rights to any content you submit, and that such content does not infringe the rights of any third party. We reserve the right to remove any content at our sole discretion.

8. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, audio clips, software, and code — are owned by Burbank Sportscards or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted no right or license to use any intellectual property owned by us or our affiliates except as expressly permitted in these Terms. Any unauthorized use is strictly prohibited and may result in civil and criminal penalties.

9. Recording and Session Data Consent

By entering our physical store locations or using the App, you acknowledge and consent to the following:

9.1 In-Store Recording

When you visit any Burbank Sportscards physical location, you may be photographed, filmed, or otherwise recorded via surveillance cameras, staff-operated cameras, mobile devices, or other recording equipment. Such recordings may be made without additional notice beyond this disclosure.

9.2 App Session Recording

When using the App, we use LogRocket to capture session recordings — including taps, scrolls, navigation patterns, and screen content — for internal review, quality assurance, bug diagnosis, and usability improvement. You may opt out of session recording and analytics data collection through the App by navigating to Profile > Settings > Usage Data and disabling analytics.

9.3 Use of Recordings

Any recordings — whether made in-store or digitally — may be used by Burbank Sportscards for any lawful purpose, including but not limited to:

• Social media posts and campaigns across any platform

• Marketing, promotional, and advertising materials (digital and print)

• Website and App content

• Internal training, quality assurance, and operational review

• Security and loss prevention

• Any other commercial or non-commercial purpose at our sole discretion

By entering our stores or using our App, you grant Burbank Sportscards a royalty-free, perpetual, irrevocable, worldwide license to use your likeness, voice, and image in any such recordings for the purposes described above. If you do not consent to being recorded, please notify a staff member immediately upon entering a store location.

10. Third-Party Services

We use various third-party tools and platforms to operate, improve, and support the App and our business. By using the App, you acknowledge and consent to your information being processed by these services in accordance with their respective privacy policies.

10.1 Shopify (Authentication, Checkout, and Customer Data)

We use Shopify to power customer authentication, product catalog management, checkout and payment processing, and order fulfillment. Shopify receives your account information, payment details, and order history. Shopify's data practices are governed by its own privacy policy, available at shopify.com/legal/privacy.

10.2 Smile.io (Loyalty and Rewards)

We use Smile.io to power our Collector's Club loyalty and rewards program. Smile.io may receive your email address and account information in order to:

• Enroll you in and manage your rewards account

• Look up your account status and points balance

• Send you rewards-related email communications and notifications

• Track qualifying purchases and redemptions

Smile.io's data practices are governed by its own privacy policy, available at smile.io/privacy-policy. You may opt out of rewards-related communications by contacting us or adjusting your account preferences.

10.3 LogRocket (Session Recording and Analytics)

We use LogRocket to help us understand how users interact with the App. LogRocket may collect and record:

• Session replays, including taps, scrolls, and navigation patterns

• Screens and features you access within the App

• Performance metrics, error logs, and crash reports

• Device and operating system information

This data is used solely to improve the App experience, diagnose technical issues, and optimize features. You may opt out of LogRocket data collection through the App's Usage Data settings. LogRocket operates under its own privacy policy, available at logrocket.com/privacy.

10.4 Expo (Push Notifications)

We use Expo's push notification service to deliver notifications to your device. Expo receives your device push token in order to route notifications. Expo's data practices are governed by its own privacy policy, available at expo.dev/privacy.

10.5 Other Third-Party Services

We may engage additional third-party service providers from time to time to assist with analytics, customer support, and other operational functions. These providers may access your information only as necessary to perform services on our behalf.

We are not responsible for the privacy practices or content of any third-party services. We encourage you to review the privacy policies of any third-party services you interact with through the App.

11. Disclaimers of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING.

WE DO NOT WARRANT THAT: (A) THE APP WILL MEET YOUR REQUIREMENTS; (B) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) RESULTS OBTAINED FROM USE OF THE APP WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE APP WILL BE CORRECTED.

PRODUCT PHOTOGRAPHS AND DESCRIPTIONS ARE PROVIDED FOR INFORMATIONAL PURPOSES. ACTUAL PRODUCT CONDITION, COLOR, AND APPEARANCE MAY VARY. BURBANK SPORTSCARDS MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE FUTURE VALUE OF ANY SPORTS CARDS OR COLLECTIBLES PURCHASED THROUGH THE APP.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BURBANK SPORTSCARDS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL OR FINANCIAL LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

13. Indemnification

You agree to defend, indemnify, and hold harmless Burbank Sportscards and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms

• Your use of the App

• Your violation of any third-party rights

• Any fraudulent or illegal conduct by you

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, in our sole discretion. Upon termination, all licenses and rights granted to you in these Terms will immediately cease. Sections 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, and 17 shall survive termination.

You may terminate your account at any time by using the account deletion feature within the App or by contacting us. Termination does not relieve you of any obligations incurred prior to termination.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction and venue of courts located in Los Angeles County, California for any disputes not subject to arbitration.

15.2 Mandatory Arbitration

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION UNDER THE AMERICAN ARBITRATION ASSOCIATION'S CONSUMER ARBITRATION RULES. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

15.3 Class Action Waiver

YOU AND BURBANK SPORTSCARDS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

15.4 Statute of Limitations

ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE APP MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION AROSE, OR SUCH CLAIM IS PERMANENTLY BARRED.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Burbank Sportscards with respect to the App and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16.3 No Waiver

Our failure to exercise any right or enforce any provision shall not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemics, government actions, or internet outages.
